1. Introduction

These Terms of Service ("Terms") govern the use of the farm consulting services ("Services") provided by Peak Ag Farm Consulting Business ("we," "our," or "us") to farmers and farm entities in New Zealand. By using our Services, you agree to these Terms. If you do not agree with these Terms, please do not use our Services.

2. Services

2.1. Scope of Services:  We offer farm consulting services, including but not limited to farm management, strategic planning, advice on crop and livestock production, sustainability, and other related agricultural matters.

2.2. Engagement: Our Services are available to farmers and farm entities in New Zealand. The scope and duration of the Services will be detailed in a separate written agreement, including the services to be provided, fees, and any specific terms and conditions.

3. Fees and Payment

3.1. Payment Terms: The fees for our Services will be outlined in the written agreement. Payment terms, including due dates, methods of payment, and any late fees, will also be specified.

4. Client Responsibilities

4.1. Cooperation: Clients agree to provide accurate information and cooperate with us to enable the effective provision of our Services.

4.2. Access: Clients may need to provide us with access to their farm premises and relevant records as required for the Services. Such access will be discussed and agreed upon in advance.

5. Confidentiality

5.1. Confidential Information: We will keep all client information and data confidential, and we will not disclose it to third parties without the client's express consent, unless required by law.

6. Liability and Indemnification

6.1. Limitation of Liability: We will provide our Services with reasonable care and skill. However, we do not guarantee specific results, and our liability is limited to the amount paid for the Services.

6.2. Indemnification: Clients agree to indemnify and hold us harmless from any claims, losses, or liabilities arising from the use of our Services.

7.1. Termination: Either party may terminate the engagement by providing written notice, subject to any termination provisions in the written agreement.

8. Governing Law

8.1. Governing Law: These Terms are governed by and interpreted in accordance with the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of New Zealand courts.

9.1. Changes: We may update these Terms from time to time. Clients will be notified of any changes, and the revised Terms will be posted on our website.
